Terms of Service
TERMS OF SERVICE / PUBLIC OFFER AGREEMENT
FOR THE DISTANCE SALE OF GOODS

This document constitutes the official public offer and Terms of Service of the MÚIZ / QOȘKAR MÚIZ online store, available at muiz.kz, and sets out the terms and conditions governing the distance sale of goods through the Website.
By placing an order on the Website and/or paying for Goods, the Buyer confirms that they have read, understood and fully accepted these Terms of Service.
1. General Provisions
1.1. The Seller is "Daira Trading FZC", engaged in the sale of clothing and accessories under its own brand through the online store muiz.kz.
1.2. These Terms constitute a public offer. Placing an order on the Website and/or paying for the Goods shall constitute the Buyer’s full and unconditional acceptance of these Terms.
1.3. The Buyer is any legally capable individual who places an order through the Website muiz.kz.
1.4. The Website is the online store muiz.kz through which goods under the MÚIZ / QOȘKAR MÚIZ brand are sold.
1.5. The Seller reserves the right to amend these Terms at any time. The current version of the Terms shall always be available on the Website.
1.6. These Terms are governed by the laws of the Republic of Kazakhstan, unless otherwise required by mandatory applicable law.
2. Subject Matter
2.1. The Seller undertakes to transfer ownership of the Goods presented on the Website to the Buyer, and the Buyer undertakes to pay for and accept such Goods.
2.2. The product range, descriptions, images, sizes, colours, specifications, materials, prices and other characteristics of the Goods are published on the Website.
2.3. The Goods are sold in limited drops, collections and batches. Once a particular drop has ended, the relevant Goods may be withdrawn from sale or marked as “Sold Out.”
2.4. Certain Goods may be available for pre-order. The pre-order terms and estimated production, availability or dispatch dates shall be specified on the Website or communicated to the Buyer separately.
2.5. Custom tailoring, personal alterations or made-to-measure production are not provided unless expressly stated on the Website or separately agreed with the Buyer in writing.
3. Product Information
3.1. The Seller makes reasonable efforts to ensure that product descriptions, images, colours, sizes and prices on the Website are accurate and up to date.
3.2. Product images are provided for informational purposes. The actual colour, texture, fit and visual appearance of the Goods may vary slightly due to lighting, photography, screen settings and individual perception.
3.3. Where the product includes embroidery, ornamental details or decorative elements, the Seller makes reasonable efforts to display them accurately. Minor variations may occur due to production, fabric structure or photography conditions.
3.4. The Buyer is responsible for checking the selected size, colour, quantity and product details before placing an order.
4. Placing an Order
4.1. The Buyer independently places an order through the Website.
4.2. When placing an order, the Buyer shall provide the necessary information, including:
first and last name;
telephone number;
email address;
delivery address;
country;
city;
postal code;
selected delivery method;
selected payment method;
product size, colour and quantity.
4.3. The Buyer is responsible for the accuracy and completeness of the information provided.
4.4. The Seller shall not be liable for delivery delays, failed delivery, additional delivery costs or customs issues caused by incorrect or incomplete information provided by the Buyer.
4.5. An order shall be deemed accepted once it has been placed through the Website. The order shall be submitted for processing after payment has been successfully confirmed.
4.6. The Seller reserves the right to contact the Buyer to clarify order details, delivery information or payment-related information.
4.7. The Seller may cancel an order if the Goods are unavailable, if payment is not completed, if the Buyer provides incorrect information, or if the Seller is unable to contact the Buyer when clarification is required.
5. Prices and Payment
5.1. Product prices are displayed on the Website in U.S. Dollars (USD), unless otherwise stated on the Website.
5.2. Payment for an order is made online by bank card or by other payment methods available through the Website.
5.3. Online payments are processed through Stripe, a secure international payment provider.
5.4. Depending on the Buyer’s country, card issuer, device and Stripe availability, the Buyer may be able to pay using Visa, Mastercard, Apple Pay or other payment methods supported by Stripe.
5.5. The Buyer enters payment details on the secure payment page provided by Stripe. The Website muiz.kz does not store the Buyer’s bank card details.
5.6. If the Buyer’s card is issued in a currency other than USD, the Buyer’s bank or card provider may convert the payment amount into the Buyer’s local currency. The final charged amount may depend on the exchange rate and fees applied by the Buyer’s bank or card provider.
5.7. An order shall be deemed paid once the payment has been successfully confirmed by the payment provider and the payment status of the order has been updated on the Website or in the Seller’s order management system.
5.8. The Seller reserves the right to change product prices unilaterally. Price changes shall not apply to orders that have already been placed and paid for.
5.9. If payment fails, is cancelled or is declined by the payment provider or the Buyer’s bank, the order shall not be processed until successful payment is completed.
6. Delivery
6.1. The Seller ships orders from Kazakhstan to international customers.
6.2. Available delivery methods are displayed on the Website during checkout or communicated to the Buyer separately.
6.3. For most international orders, the Seller uses DHL Express.
6.4. For selected CIS countries, including Russia and Kyrgyzstan, the Seller may use CDEK delivery where this method is available.
6.5. Delivery availability, delivery cost and estimated delivery time may depend on the destination country, city, postal code, parcel weight, parcel dimensions, customs procedures and the availability of the selected delivery service.
6.6. Orders are usually processed after payment confirmation. Standard order processing time is normally 1–3 business days, unless otherwise stated on the Website or communicated to the Buyer.
6.7. During drops, launches, holidays, promotional periods or high-demand periods, processing may take longer.
6.8. Estimated delivery times are provided for informational purposes only and are not guaranteed.
6.9. DHL Express international delivery usually takes several business days after dispatch, depending on the destination country and customs clearance.
6.10. CDEK delivery time depends on the destination country, destination city and regional service availability.
6.11. Once the order has been handed over to the delivery service, the Buyer may be provided with a tracking number.
6.12. The Seller shall not be liable for delivery delays caused by customs procedures, delivery services, postal operators, transport companies, weather conditions, holidays, courier workload, government restrictions or other circumstances beyond the Seller’s reasonable control.
7. Customs, Duties and Import Taxes
7.1. International orders may be subject to customs duties, import taxes, VAT, brokerage fees or other local charges in the destination country.
7.2. Such charges are not included in the product price or delivery fee unless expressly stated otherwise at checkout.
7.3. The Buyer is responsible for paying any customs duties, import taxes, VAT or other charges required by the destination country.
7.4. The Seller is not responsible for delays caused by customs clearance, customs inspections or the Buyer’s failure to provide information requested by customs authorities or delivery services.
7.5. If the Buyer refuses to pay customs duties, import taxes or other required charges, or refuses to accept the parcel, any return shipping costs, customs charges, storage fees or other expenses may be deducted from any refund, where permitted by law.
8. Returns and Exchanges
8.1. The Buyer may contact the Seller regarding the return or exchange of Goods in accordance with the procedures and time limits established by applicable law and the return policy published on the Website.
8.2. Goods of satisfactory quality may be returned or exchanged only if the following conditions are met:
the Goods are unused;
the original saleable condition is preserved;
the consumer properties of the Goods are preserved;
the original labels, tags and packaging are preserved;
there are no signs of wear, washing, damage, staining, odours, alteration or any other signs of use.
8.3. Goods that have been used or show signs of wear, washing, damage, staining, odours, missing tags or loss of their original saleable condition shall not be eligible for return or exchange, except where otherwise required by law.
8.4. Refunds shall be issued only after the Seller has received the returned Goods and inspected their condition.
8.5. Refunds are normally processed back to the original payment method used for the order.
8.6. Refund processing time may depend on Stripe, the Buyer’s bank and the Buyer’s card issuer.
8.7. The Buyer shall bear the cost of returning Goods of satisfactory quality, unless otherwise agreed with the Seller or required by law.
8.8. Delivery fees, customs duties, import taxes, brokerage fees and other third-party charges are non-refundable unless otherwise required by law.
8.9. If the Buyer receives defective or incorrect Goods, the Buyer shall contact the Seller within a reasonable time and provide the order number, photographs and a description of the issue.
8.10. If the defect or error is confirmed, the Seller may offer a replacement, exchange, refund or other appropriate solution in accordance with applicable law.
9. Buyer’s Rights and Obligations
9.1. The Buyer has the right to:
receive information about the Goods, payment, delivery, returns and exchanges;
place orders through the Website;
contact the Seller regarding an order;
request a return, exchange or refund in accordance with these Terms and applicable law.
9.2. The Buyer shall:
provide accurate and complete order information;
pay for the order using the selected payment method;
accept the delivered Goods;
track the parcel where tracking information is provided;
pay customs duties, import taxes and other charges required by the destination country;
contact the Seller promptly if any issue with the order arises.
10. Seller’s Rights and Obligations
10.1. The Seller shall:
provide information about the Goods on the Website;
process paid orders;
transfer the Goods to the delivery service;
provide tracking information where available;
process the Buyer’s personal data for the purpose of fulfilling the order;
comply with these Terms.
10.2. The Seller has the right to:
change the product range, prices, delivery terms and promotional conditions;
refuse or cancel an order if the Goods are unavailable;
contact the Buyer to clarify order details;
cancel an order if the Buyer provides incorrect information or cannot be contacted;
temporarily suspend the Website for maintenance, updates or technical reasons.
11. Personal Data
11.1. By placing an order through the Website, the Buyer consents to the collection and processing of personal data for the purposes of order placement, payment processing, delivery, communication, returns, exchanges, customer support and fulfilment of the Seller’s obligations.
11.2. Personal data may include the Buyer’s name, telephone number, email address, delivery address, order details, payment status and other information necessary to fulfil the order.
11.3. Personal data shall be processed in accordance with the Privacy Policy published on the Website.
11.4. The Seller may transfer necessary personal data to third parties only where required for order fulfilment, including payment providers, delivery services, technical service providers, customer support tools or where required by law.
12. Limitation of Liability
12.1. The Seller shall not be liable for:
delivery delays caused by delivery services, customs authorities or third parties;
failed delivery caused by incorrect or incomplete information provided by the Buyer;
customs duties, import taxes, VAT or other local charges in the destination country;
temporary technical failures affecting the Website, payment provider or delivery services;
minor differences between the actual Goods and product images caused by lighting, photography or screen settings;
the Buyer’s inability to place or pay for an order due to the actions of banks, payment systems, internet providers or other third parties;
force majeure circumstances.
12.2. Nothing in these Terms excludes or limits any rights of the Buyer that cannot be excluded or limited under mandatory applicable law.
13. Force Majeure
13.1. The parties shall be released from liability for partial or complete failure to perform their obligations where such failure results from force majeure circumstances beyond their reasonable control.
13.2. Such circumstances may include natural disasters, war, military actions, civil unrest, epidemics, pandemics, government restrictions, customs restrictions, disruptions affecting payment systems, delivery services, internet services, banking infrastructure, logistics infrastructure or other events beyond the reasonable control of the parties.
14. Intellectual Property
14.1. All content on the Website, including photographs, text, graphics, logos, product names, designs, visual materials, brand elements and other content, belongs to the Seller or is used by the Seller lawfully.
14.2. The Buyer may not copy, reproduce, distribute, publish, modify or use Website content for commercial purposes without the Seller’s prior written consent.
15. Dispute Resolution
15.1. The parties shall endeavour to resolve all disputes and disagreements through negotiation.
15.2. The Buyer may submit a complaint, question or request to the Seller using the contact details provided on the Website.
15.3. If the dispute cannot be resolved through negotiation, it shall be resolved in accordance with the laws of the Republic of Kazakhstan, unless otherwise required by mandatory applicable law.
16. Final Provisions
16.1. These Terms shall enter into force upon publication on the Website and shall remain in effect indefinitely.
16.2. The Buyer’s placement of an order and/or payment for the Goods shall constitute acceptance of these Terms.
16.3. The current version of these Terms shall always be available on the Website.
16.4. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
